Silver Birch Tree causing damage to wall.

The Silver Birch tree is causing structural damage to a shared perimeter wall. In addition, the tree has become a safety hazard as its branches are overgrown and prone to falling onto my property, especially during storms or strong winds. Numerous branches have already fallen and in past times, causing damage to my property which was temporarily rectified by the council i.e., the offending branches were trimmed. The leaves, and seeds constantly block the guttering, causing them to overflow and spill down my external walls. I have recently had some landscaping done to my property and was alarmed to find rather large roots only a couple of feet away from the main building.
We raised this issue approximately 5 years ago. The council representative acknowledged the tree was causing damage and was indeed to close to the property. The tree is approximately 4 meters from my actual building and approximately 1.5 meters from my boundary. My understanding was that this matter was going to be addressed. With the events that unfolded regarding the Covid outbreak, we were informed that resourcing and priorities were affected. A second representative came out approximately 12 months later and stated the tree would be removed by October 2022.
Nothing has been done thus far. However, after 5 years, we feel we have been patient and considerate in this matter. Bearing in mind trees next to the offending Silver Birch have been deemed to have caused structural damage to the property adjacent to my property.
