Fence replacement

When I was given the property it had a make shift 6 ft fence and the council never removed it when I moved in then the high winds blow it down and the council only replaced it with a 3 ft fence saying there was no permition and now the naibers kids climb my fence it is dangerous and My akita do escapes and as per the tenancy agreement you should have replaced for a 6ft under the like for like policy but refuse to do this
